1. Introductory provisions

1.1 These Terms and Conditions (the “T&Cs”) govern the rights and obligations between the seller and the buyer when concluding purchase contracts through the geo.guru online store.

1.2 The operator of the online store is:

1.3 The buyer is a consumer, i.e., a natural person who does not act within the scope of their business activities or profession when concluding the contract.

1.4 These T&Cs are governed by the laws of the Czech Republic, in particular Act No. 89/2012 Coll., the Civil Code, and relevant European Union legislation.

2. Information about products and digital content

2.1 The seller offers in particular:

• geocaching containers,
• logbooks,
• travel bugs, travel tags, geocoins,
• accessories,
• digital products and activation codes.

2.2 Some products may include a unique tracking or activation code intended for use on the Geocaching.com platform.

3. Conclusion of the purchase contract

3.1 The purchase contract is concluded upon confirmation of the order by the seller after the buyer submits the order.

3.2 By submitting an order, the buyer confirms that they have read and agree to these T&Cs.

4. Price and payment terms

4.1 Prices are stated in CZK or EUR and include VAT unless stated otherwise.

4.2 The buyer may pay by:

• bank transfer,
• cash on delivery (if available),
• payment card.

4.3 A fee is charged only for cash on delivery payments.

4.4 Card payments are processed via the Shoptet Pay payment gateway. Payment details are not stored by the seller.

5. Delivery conditions

5.1 The seller arranges delivery through carriers available in the checkout process.

5.2 Products are dispatched from the Czech Republic. Orders are usually dispatched on the next business day, but no later than within 5 business days after the order is received.

5.3 Shipping costs are always displayed before the order is confirmed.

6. International sales and customs

6.1 The seller delivers to European Union countries and selected third countries.

6.2 For deliveries outside the European Union, any customs duties, taxes, and import fees are borne by the buyer. These fees are not included in the purchase price.

7. Withdrawal from the contract

7.1 The buyer has the right to withdraw from the contract without giving any reason within 14 days from the day the goods are received.

7.2 Withdrawal must be notified to the seller by an unequivocal statement (e.g., by email).

7.3 The right to withdraw does not apply to:

1. digital content not supplied on a tangible medium, if the performance has begun with the buyer’s express consent before the expiry of the withdrawal period and the buyer acknowledged that they thereby lose the right of withdrawal,
2. goods made to the buyer’s specifications or clearly personalised.

7.4 The buyer must send the goods back within 14 days from the day of withdrawal.

7.5 The seller will refund all payments received, including delivery costs, within 14 days from the day of withdrawal, using the same payment method that was used for the transaction, unless otherwise agreed.

8. Liability for defects and complaints

8.1 Rights arising from defective performance are governed by the relevant provisions of the Czech Civil Code.

8.2 The buyer is entitled to submit a complaint without undue delay after discovering a defect.

8.3 The seller will decide on the complaint without undue delay, no later than within 30 days from the date the complaint is submitted.

8.4 Liability for defects does not apply to defects caused by improper use of digital content or an activation/tracking code by the buyer.

9. Returns

9.1 The buyer may exercise the right of withdrawal in accordance with Section 7 of these T&Cs.

9.2 To speed up processing, we recommend contacting the seller before sending the goods back; however, this is not a condition for exercising the right of withdrawal.

9.3 Return shipping costs are covered by the seller via a return label, unless otherwise agreed by the parties.

10. Personal data protection

10.1 Personal data is processed in accordance with the GDPR and applicable legal regulations.

11. Out-of-court dispute resolution

11.1 The buyer has the right to out-of-court resolution of consumer disputes via the Czech Trade Inspection Authority.

11.2 The buyer may also use the EU Online Dispute Resolution (ODR) platform.

12. Final provisions

12.1 These T&Cs are valid and effective from the date of publication.

12.2 The seller reserves the right to amend these T&Cs; amendments take effect on the date of publication.
